Buying or selling property must rate as one of life's most important financial decisions. It stands to reason, these transactions must be settled properly.
 
You have the right to choose an Independent Settlement Agent who will represent you and look after your best interests at all times.
 
The settlement process is the most important part of the buying or selling process and yet it is one area which is often given the least consideration.
 
Remember the cheapest may not normally be the best
 
Settlement Agents have the huge responsibility of conveying an interest in the land from a seller to a buyer. No two settlements are the same as there are many variables that can impact on the settlement process.  At Star Settlements we only employ Senior Licenced Conveyancers wih in excess of 60+ years experience.
 
RESPONSIBILITIES FOR BUYERS

  • Receipt Offer and Acceptance Contract and confirm all special conditions are satisfied within the required time frame. 
  • Obtain written evidence that special conditions are met by way of waiver or evidence thereof.
  • Prepare documentation including Transfer of Land (if a paper settlement) and where applicable Statutory Declarations, applications, etc.
  • Provide copy documentation to Buyer's lender
  • Liaise with the buyer, real estate agent, buyer's lender, seller's settlement agent confirming the settlement process is proceeding and where necessary resolving any problems to ensure dealing remains on track
  • Arrange for online lodgement of Offer and Acceptance Contract and payment of duty with  the State Revenue Department within the required time frame to avoid late lodgement penalties. 
  • Apply to rating authorities to inform them of change of ownership and obtaining written information pertaining to the property confirming:- 
    • Status of rate accounts
    • Property information
    • Zoning
    • Outstanding orders and requisitions
    • Landgate Property Information Report , on request
  • Opening of the PEXA platform and inviting all parties for an electronic settlement
  • Follow up on any outstanding council orders to ensure compliance and satisfaction prior to settlement
  • If the property is rented request copies of tenancy information, ie Tenancy Agreements, Property Condition Reports etc.
  • Arrange for rental to be adjusted at settlement and bond to be transferred to the buyer's managing agent.
  • Arrange settlement with Buyer's lender and Seller's Settlement Agent.
  • Advise client and Real Estate Agent that settlement has been arranged. 
  • Attend settlement and lodgement of documentation at Landgate for registration. (when a paper settlement)
  • Advise real estate agent and client once settlement has been completed 
  • Attend to payment of all outstanding rates and taxes at settlement and follow through with 
  • Seller's settlement agent to ensure payment of water consumption up to the date of settlement
  • Search Certificate of Title for Buyer at Landgate approximately six weeks after settlement (if a paper settlement) within 24 hours (if a PEXA settlement) to confirm property has been correctly registered in buyers name and provide a copy of Title search to buyer confirming the same. 
  • Completion of your Verification of Identity
  • Collection of ATO clearance certificate from Seller when applicable
  • Advise real estate agent and client once settlement has been completed

RESPONSIBILITES -  FOR SELLERS

(Following fraudulent sales of property in Western Australia, Landgate have put into place various security requirements to help protect owners from sale of their property without their knowledge. 
These regulations include the requirement of a verification of identity to be registered with the Transfer of Land Document and any other documents registered at Landgate.  Therefore, prior to
settlement, we are required to identify you and complete a Certificate of Identity.
To complete this process, each Registered Proprietor will need to physically  call into our office and bring their original identity documents with the total point value of 100.  Ie;  these documents must reflect the same name ( correct spelling and order of names) as is noted on the Certificate of Title. (We suggest a current Australian Passport and a current Australian Drivers Licence). If the name on the Certificate of Title differs from that shown on the Identity documents, a Statutory Delcaration and accompanying original documentation ie Marriage Certificate/Change of name Licence/Divorce Papers will be required for lodgement at Landgate.
If you are unable to physically call into our office for identification, the Identification Certificate can be completed at a major Australia Post Office who is eligible to perform this duty for a small fee,  they will require a form provided by this office, however if you prefer
to call into our office with your original identity documents, we are able to complete the Certificate of Identity for you.)

  • Prepare documentation and notify discharging Bank of forthcoming settlement.
  • Request Seller contact Bank to complete and sign Discharge of Mortgage authority (THE DISCHARGING BANK HAS NO RESPONSIBILITY TO PROCEED TO SETTLEMENT UNTIL SUCH TIME AS THEY ARE IN RECEIPT OF A SIGNED DISCHARGE AUTHORITY FROM THE SELLER)
  • Liaise with the seller,  sellers's lender and buyer's settlement agent confirming the settlement process is proceeding and where necessary resolving any problems to ensure dealing remains on track
  • Arrange for execution of the Transfer of Land document by the Seller (if a paper settlement) and complete Identification of the each Seller/Registered Proprietor (see above for information regarding identification regulations)
  • Liase with Rating Authorities to confirm moneys owed for Rates and Water Consumption up to the date of Settlement.
  • Identify if the property is rented and arrange for rental to be adjusted at settlement and Bond transferred to the buyer's managing agent. 
  • Accepting the PEXA platform invitation and inviting the required parties
  • Insuring Verification of Identity is completed
  • If applicable guiding you in regards to the completion of your ATO Clearance Certificate
  • Arrange settlement with Selle'rs lender and Buyer's Settlement Agent.
  • Advise client and Real Estate Agent that settlement has been arranged.
  • Attend settlement and lodgement of documentation at Landgate for registration.(If a paper settlement)
  • Advise real estate agent and client once settlement has been completed
